A Little History About the Law of the Land

If you want to understand the constitution, you have to understand what preceded it. July 4, 1776 is NOT the beginning of the United States. It is when the Declaration of Independence was finalized. The first constitution (actual laws) did not come about until March 1, 1778 when the Articles of Confederation were adopted and in force.

The Articles of Confederation.

The AofC did not really create a nation as we think of one. What they really did was created something more akin to the European Union; but, weaker. One of the things in the AofC was a statement about militias. "No vessel of war shall be kept up in time of peace by any State, except such number only, as shall be deemed necessary by the united States in congress assembled, for the defense of such State, or its trade; nor shall any body of forces be kept up by any State in time of peace, except such number only, as in the judgement of the united States, in congress assembled, shall be deemed requisite to garrison the forts necessary for the defense of such State; but every State shall always keep up a well-regulated and disciplined militia, sufficiently armed and accoutered, and shall provide and constantly have ready for use, in public stores, a due number of field pieces and tents, and a proper quantity of arms, ammunition and camp equipage."

See the part where the AofC used the same term as used in the later Constitution, "well-regulated and disciplined militia"? The exact same reason the current Constitution protected gun ownership. Gun ownership was never considered a personal right by the founders. Sorry guys; but, it just wasn't and more importantly even states were prohibited to have warships without the express permission of the United States. Another interesting point is that Article XI (11) allowed Canada to join the United States if it so chose. And who had the right to vote? That was left up to the individual states and guess what, in the South blacks didn't even count as one vote; but, when they created the constitution, slaves counted as 3/5ths of a vote even though they still could not vote. That meant that the white landowners in the south's votes were each worth 1 and 3/5ths that of people living in the north.

In many ways the Articles of Confederation were a wealthy man's privilege in legal form. It was 13 oligarchies controlling their own individual states, true states rights. The current Constitution was fully ratified in May of 1790 (though 11 states had already ratified and were technically the United States). The US Constitution was meant to limit state rights and strengthen the federal government because the Articles of Confederation had failed so badly.

Lets get back to gun rights for a moment. When preparing the "Bill of Rights", James Madison originally wanted it to say, "The right of the people to keep and bear arms shall not be infringed; a well armed, and well regulated militia being the best security of a free country: but no person religiously scrupulous of bearing arms, shall be compelled to render military service in person." Notice how the same sentence is about keeping and bearing arms and the ability to refuse military service in person. That in person part meant that you could pay someone else to do your fighting for you and that happened a lot. The Bill of Rights went into effect on December 15, 1791. You know how we know that the Constitution did not give you an individual right to bear arms? Simple, it was ILLEGAL for slaves to own guns in many states. They were counted as 3/5ths of a person according to the Constitution, yet, they could not own guns. I should also point out that Japanese Americans who were put in determent camps during World War II. Heck, in the 1800s the police often required you to turn in your guns before coming into town and that was cowboys. Even today we prohibit felons from owning guns and from voting. Don't tell me you a constitutional strict constructionist if you think felons lose the ten amendments, that my friends is not in the constitution.

A true strict constructionist attempts to determine what the people who approved the Constitution and amendments meant when they wrote it and lets be clear, they didn't believe the same things we do. The Constitution was meant to keep state oligarchies in power while giving greater central control over the nation to the central government. If you want to be really strict in your construction of the Constitution, the abolition of slavery is sort of a dodgy question as there was no Constitutional Amendment abolishing it, that was done by executive decree, specifically, The Emancipation Proclamation and really only applied to Confederate states.

Bees, Sperm Counts and Questions

International Business Times - Sperm Count Declines Worlwide, Western Men See Record Low Fertility. Lets start with the basic facts and point out where the title of the article is intentionally misleading. Sperm counts have NOT declined worldwide, just in the western nations. There has been a 59% decrease in sperm counts in men in Europe, the North America, Australia and New Zealand since 1973. They have found NO decline in South America, Africa or Asia.

While this has been studied since the early 1970s, scientists still have no idea as to what is causing it, or so we are told. In fact, they have stated that smoking, obesity and even global warming may be causing it; but, those are lies. Lets start with smoking, it has been steadily decreasing in the west since the late 1960s, not increasing. However in the places where sperm counts are not going down, smoking has either remained relatively the same or increased, such as in Asia. Obesity also does not explain it. As for global warming, that is just laughable as global means global and the impact would be worldwide, not just in western countries.

So why doesn't the media care more about this issue? Why aren't western governments freaking out and spending the same amount of attention to this issue that they do to global warming. I mean, after all, at this rate the sperm count in western males will be zero in another 40 years. It's just math. Could this be due to hormones in our foods? Could it be due to chemicals in our environment (actually the west regulates chemicals in our environment much more than does China, India, Africa or South America where sperm counts are not declining)? I guess the only people that don't need to be worried about global warming are people living in the western world because we won't live to see it.

CBS News - 40 percent of U.S. bee colonies died in past year. In 2015 this report came out. Again, very large numbers and no overwhelming concern from the media. It is mentioned; but, not very often, certainly not as often as whether or not Trump likes one or two scoops of Ice Cream or whether or not transgenders should be in the military (all 250 of them). So what is killing the bees? The most likely candidate is pesticides.

It is bad enough that western societies have dropped their birth rate by refusing to have children, in the future they won't be able to. Oh, and just in case you think this is a "white male" thing, it is not, it is all westerners, blacks, whites and Arab, Asian, African immigrants who move to the western world. The drop is not genetic, it is environmental.

Speech Crime

USA Today - Suicide texting case sets bad precedent, experts say.

CNN - The text messages that led up to teen's suicide.

A 17 year old girl got regular text messages from her boyfriend where he said he was going to kill himself. At first she tried to get him to go to therapy and much later told him to just do it. He did. He killed himself. She was charged with murder and ended up getting two and a half years for involuntary manslaughter.

Murder by speech. Murder by text message? It was not murder, it was not manslaughter. It was suicide. My wife left me for another man and took everything I had. I did not commit suicide, though I was quite ready to die. Even Jim Jones actually put a gun to people's heads to make them drink the Koolaid. Please tell me, was she responsible for not stopping him. She didn't bring up the idea, he did. I guess she wasn't a very good psychologist at 17. Maybe she was a really dumb child; but, she was still a child. She is now paying for his sin, not hers.

Tell me you have never wished someone dead. Tell me you have never told another to just die or wished that they would. We are going to charge you for the air you breath, a carbon tax. And, we are going to hold you guilty for bad thoughts and bad words, hate speech. Do you think that slaves wished their masters dead? The most oppressive slavery starts by outlawing words and then thoughts.

What Is Free Speech?

Does freedom of speech mean the freedom to be heard? Does it mean the freedom to explore ideas that are wrong in the opinion of the majority or specific groups? Does it include the right to call other people "nigger" or "faggot" or "Nazi" or "bitch" or "fuckhead"? Does it include the right to discuss the history of those words or what they used to mean? Does it include the right to discuss similarities amongst the people who use those terms? Can I at least discuss whether or not whites can say "nigger" or just blacks? My regular readers know that I do not use such terms in this blog; but, can I if it helps us to ask other questions? Am I free to bring up these issues? How can I talk honestly about the KKK if I don't use these words to explain what they believe?

What is freedom of speech and why does it matter? Can we outlaw the letter N or F? What if racists and homophobes started just using the letter instead of saying the word, could we outlaw that and would we want to outlaw a letter? You cannot outlaw a concept or a belief set. You cannot make it illegal to hate blacks or gays. You cannot legislate the ten commandments. How do you make it illegal for people to love Satan or a rock more than God? You cannot even legislate the first commandment because you cannot outlaw beliefs or love.

YouTube is attempting to regulate what people can discuss and they want to use computer programs to do it. Billionaires intend to regulate what you can say over the internet by telling computers what you can and cannot say. After the programs are written they will tell you it is fair because the computer is choosing what is good and bad. Computers cannot make moral decisions. They have no soul and do not have to live with the consequences because they have no life, they are just formulas being run by calculators, nothing more.

More books were sold last year as computer files than as physical books. More e-mails are sent in a day than are physical letters in a year, I will bet you. They don't even teach handwriting in school anymore. Try getting hold of a printing press and the ink and the paper. The infrastructure that would allow publishing written materials is going bye bye and what will be left will be very expensive.

Now lets talk about the internet. Do Muslims in Saudi Arabia have the right to use the internet to say they hate Jews on Arab websites? Do blacks in Africa have the right to discuss how the Europeans should all die for having stolen their people and their lands? Do American Indians have the right to use the internet to discuss how the white man came and took their lands and should all die? Do I have the right to say that a quarter of the English should starve to death as they starved my family, the Irish to death? Will I be free to read the New York Times editorial that said that the famine in Ireland might solve the "Irish Problem"? Should I be able to read Nazi propaganda from the 30s and 40s online so that I can understand how they did what they did?

If it is legal to have the Playboy channel on cable then should it be illegal to post the pictures online? I personally would not like it to be illegal for Penn Jillette of Penn and Teller to be prohibited from saying people that believe in God are idiots. FYI, he doesn't tend to do that, he is usually a respectful atheist as he is also a Libertarian and one of the best magician ever. Heck, I would be more than comfortable and happy to actually have an in depth religious discussion with him. As much as I know he believes in free speech who hid probably not agree with the next part of this post.

If the only way to communicate with the world is the internet than restrictions on what you can and cannot say are immoral if they prohibit the free exchange of ideas, even ones I find repulsive or threatening. You cannot legislate consent. It is wrong for Facebook, YouTube and Google to regulate belief when they are the center of social discussion.

If China regulates what you can say on the internet we call it repression and an immoral prohibition of free speech. If Facebook does it then people on the right will say it is capitalism and fine because Facebook is not the government. How does that work in a nation where all social media is controlled by corporations?

If you say that I can start my own Facebook you would be lying to yourself as the European Union now claims the right to fine you for what goes on the internet. What if we placed the exact same rules on the internet that we place on the U.S. mail? It is illegal to send child pornography using the mail system. It is however legal to send a letter to another saying that your brother in law is a no good nigger faggot xenophobe. Should your free speech end when you use a computer to speak it?

Just so you know, the current YouTube algorithm and Facebook rules could prohibit you from ever seeing this post because they would not judge the content properly. If blogger were to apply the same rules, this single blog could mark me as not being searchable.

I Know, I am not Writing Much

Let my shock fill me, the greatest minds in technology see a future coming very soon where they don't need workers. And yet, they see the problem as being one of people finding purpose when their labor is no longer needed. I met the most wonderful woman in the world on my first day of sixth grade. She was really smart and had just skipped a grade. Imagine going from 4th grade straight to 6th grade and still getting all As. She met me and could see that I didn't just have no respect for the other students, I didn't respect the teachers and knew I knew more than them and proved it daily. My teacher begged my parents to have me skip grades; but, my mother knew it would mean I would never respect others and wouldn't let it happen. I thank God for my mother keeping me back and letting me learn that even normals matter. Oligarchs and elitists don't believe what I believe, I believe everybody matters and we can all learn more. I just believe in sharing the information we learn, they don't. The girl I met in 6th grade saw my arrogance and disrespect for those less intelligent and poked me in the eye to let me know that she saw them for what they were and didn't want me to hurt them. She taught me that "you matter", not me, that everyone matters and I have loved her heart for that ever since that day, even now although she has passed on. The people who believe they are your betters have no respect for you and do not believe you matter anymore than their dogs and cats. They don't see you as important as they see themselves. Julia saved me from that.

You know, whenever I tell people that you won't own your car and they will all be self driving and electric, like I have written about for a decade, they say, "Not in my lifetime". Should I assume they believe they will be dead within 23 years?

The one thing the powerful really fear is a second French revolution where they just get wiped out for their crimes against the world. The thing they fear is you paying attention to what they are doing to keep control over you.

There is a biblical reason for all of this, bad shepherds who are hired hands and nothing more and sheep and even sheep dogs. The Pimpernel knows how the game ends, the powerful do not. Enjoy what you have, take care of one another and don't sweat it. Life, like motion, is just the passage of time. YOU MATTER.

Transgenders in the Military

Body dysmorphic disorder is basically a mental disorder whereby the person rejects their body as it is. The person with the disorder may starve themselves to death (anorexia) or seek out unnecessary body modification (the person who wants to be turned into a cat or other extreme forms of plastic surgery) or even the removal of healthy body parts (transgenderism).

Lets just deal with some basic facts. If you don't like the political implications then at least don't be a science denier. Do not associate transgender with homosexuality, they are different things. I have known many gays and only one was transgender. It is estimated that the suicide rate for transgender people is 41%. The problem they face is that no matter where you go, there you are. You do not change because you change your body, you keep the same mind and pain.

I have previously written that I don't care about who uses the bathroom and I still don't. I do have a problem with body mutilation. Funny thing is there are people who don't believe in circumcision but are completely fine with complete sex change operations. If someone came into a doctors office and said they were a one armed man in a two armed body and wanted one of their arms remove, what would your response be? Wouldn't you treat it as a psychological problem?

President Trump tweeted out that he wouldn't allow transgender people in the military and we shouldn't. The military should not be where you go to get free transgender operations. You also should not be able to get the prison system to pay for it. Neither gives free face lifts.

For me the issue is even simpler. Has there suddenly been a rash of people who have had sex change operations signing up for military service that I haven't heard about? This is a made up problem, it is a distraction from real issues. You want to know a real issue? Universal healthcare is a real issue and universal healthcare should not include sex change operations or face lifts, those are highly elective and should be paid for by the person. While I support a woman's right to control their own body and favor free condoms and birth control, abortions are an elective surgery too and should also be paid for by the person choosing it. The right to choose does not include the right to not pay for your choices. In fact, I believe their should be a tax on most plastic surgery to pay for universal healthcare. I don't know the current number but 60% of all surgeries used to be elective plastic surgeries, like liposuction and face lifts. Both of which take doctors away from doing necessary surgeries.

Male and female are not descriptions of gender identification, they are medically defines by your chromosomes, not by your opinion. XX or XY genes. Putting silicon breast implants in someone and removing their penis does not make them a woman or change their genetic makeup (though that may come someday). Find me a biologist that would disagree.

Another place where we find science deniers is on the issue of abortion. In everything except abortion we accept genetics as determining your species. Genetically unborn babies are still human. Life, according to science, is when a being exhibits certain traits, such as gas exchange, cell duplication and other actual conditions that can be married. To say that an unborn baby is not a living human is scientifically a lie. To say that we have a right to control what a woman's body is slavery and I am against outlawing abortion because I don't believe in slavery; but, that doesn't change the science.

The fact is that these issues only truly effect the person involved. So why is the discussion of transgender people in the military getting so much discussion right now. Simple, to distract from the GOPs failure to get Obamacare repealed or do anything about taxes. It's funny how Republican politicians who are against gay marriage are suddenly outraged that Trump said transgender people should not be in the military. The same people who are against universal healthcare supporting transgender rights in the military. That alone should raise a red flag and rather than getting upset, you should understand how you are being manipulated.

As an aside, the way you know you are hearing a nonsense argument is the set up. Why do people always seek to talk about gays when talking about child molesters and transgender  people, it is not the same thing. Two men having sex is not the same as a grown adult man having sex with a ten year old boy. A man having his penis removed is not the same as a man who has sex with other men. I personally find comparing having women and blacks in the military to having people who want to remove healthy parts of their body vastly different and an insult to the women and minorities in the military. I should also point out that I have zero problem with gays in the military.

I am Angry

In this life you cannot buy true love or true loyalty. You cannot buy the truth, character or honor. All of these things are given freely or not at all.

A few years ago I had a relative working for a wealthy person who lived near the Reagan Presidential Museum. My relative lived on the property. There was a fire near the museum and it was out of control. I think it was called the Simi Valley fire but I really don't remember for sure. My relative called me to say that we couldn't meet because he was watering down the roof of the house of the person he worked for so that it wouldn't catch fire. I drove out to the place and helped. The fire got within feet and I personally saved this man's horses and got someone to evacuate them.

When the fire had been put out and the problem was over, the person my relative worked for didn't even bother to say thank you to me for helping. I didn't say anything about it, I just went home. I have helped many people in my life and I have leant many more money. I have discovered that most never pay you back either and that you should never expect either help or repayment in any form. In fact, I have made people's careers and had them stab me in the back, including people I personally promoted.

The sense of betrayal can bitter and I know, my wife left me for another man, the hardest betrayal of all. Yet, somehow I forgave her in my heart and him. I still think about it sometimes; but, yea, I forgave them, they have to live with what they do and did, not me. The time to really practice forgiveness is when you are angry, that way it gets easier to forgive.

UPDATE:

I'm really mad. When I was asked to preach around five years ago, I wrote a post which asked what I would tell my kids. How do I tell my kids that I am going to be preaching? That was the post. Where the hell does someone find the ego to claim that they can explain the bible or who God is? For me, I was asked to. In fact, I was tricked into preaching. I thought it was a one off. Sort of like a guest lecturer. I didn't think it would cost me thousands and pay me nothing or last for years.

To me, agreeing to preach is a sacred honor, not a duty. I did not berate people for being bad, I challenged them to be better. I preached to gays. I didn't tell them to hate their gayness, I told them to be good gays. To honor their commitments, even relationship ones. People forget this bit from the bible; but, it is a good one as are they all. The question was raised whether believers in Christ should stay with spouses who were not believers. The answer was that as you came to Christ, so you should honor your past marital commitments. God does not tell us not to love another and once committed to them we should fulfill that promise. Gays don't understand that (and neither do Christian ones), they think those moral rules do not apply to them because they are gay. I told them that is wrong and unfortunately the statistics for gay divorces is even higher than that for straights.

I wrote about how hard it was to tell people I was going to preach when I am imperfect. Atheists view Christians as children who believe in fairy tales. I had a real job, I had a real high profile difficult job. I have a doctorate and national honors. I was recognized as an expert in multiple fields. People in other countries know who I am. My opinion was sought and still is. When I started taking in the homeless these people freaked. I took them in before I began preaching.

Most people do not believe God is real. Most people will say they believe in a God; but, the reality is that they don't believe in a real God. A sentience that can hear your every thought. He can. That is one of the more intimidating things about him. I have the feeling this blog might get a lot more interesting in the future. If anyone starts thinking about "A Christmas Carol" down the road they might make a comment when they do.

Going to church for most is just a ritual, it is just a thing you do. Most Catholics do not believe that the Pope speaks the innate word of God.

I have told the story of Abraham more than once. God asked Abraham to kill his first born and he was going to until God told him not to at the last minute. God told the Jews to kill all the Arabs in Israel and they didn't do it. They knew it was wrong; but, had used the opportunity to get some land. Free will means God lets you choose. Sometimes God tells  us to do the wrong thing. We choose when to argue the point or fail to define ourselves. There is a difference and difference is what we choose. What we choose defines us, not God. Think you cannot argue with God. Abraham argued with God over destroying Sodom and Gomorrah. Why didn't he argue with God over killing his first born?

When we choose to sell our time, we choose more than does a slave; but, not totally as we are still under duress. When I choose to work or whom I choose to work for,defines me; but, the need for money creates duress, pressure. Everybody works for somebody, how much does it matter to you who you work for or does it only matter what you are paid? If both matter than where is your line.

The moment you take to the pulpit, you know people are laughing at you. Try doing that when you control hundreds of millions a year. Try telling your kids who saw your wife leave you for another man, go preach and preach forgiveness. You better believe it when you say it. I don't mind it when Atheists laugh at me, it just gets in the way of knowing one another. I do mind it when Christians think people being willing to risk their reputation in order to preach are stupid.

We are imperfect in every way and perfect in none. Should a atheist murderer stop being an atheist or a murderer first? Wait, Jesus said what the most important commandment was, love God with all your heart ... and your neighbor as yourself or something very much like that. Once you meet the most important commandment, loving all completely, you begin working on the others one. You just wont have to because you meet the love one and all the others become second nature.
